This privacy policy applies to all information Everfund Commercial Capital, LLC (“Everfund”, “we”, “us”) collects through our website. By using or accessing our site (“Services”), you acknowledge that you accept the practices and policies delineated in this Privacy Policy, and you hereby consent that we may collect, use, and share your information in the ways defined. This Privacy Policy, or its future variations, will continue to apply if your use of our Services is discontinued by either you or Everfund. This policy only applies to our Service(s) and does not apply to the practices of any other partner or third-party provider.

The Information we collect

Everfund collects personal information when you directly interact with us by browsing our website, completing a form or application on our site, or using the chat feature with us while on our site.

We will not share your information with any third party outside of our organization, other than as necessary to fulfill your request, e.g. to obtain a specific type of financing. • Prevent fraud and prevent attacks against our websites and services

• Assign you a unique identifier so we can record: (i) websites you visit; (ii) length of time the advertisement was visible; and (iii) IP address

You have the option to block cookies and other activity tracking tools used by us; however, in doing so, you may limit the functionality and use of certain features of our services.

How we protect & store personal information

We take precautions to protect your information. When you submit sensitive information via the website, your information is protected both online and offline. We store and process your personal information using third-party servers located in secure data centers in the United States. Wherever we collect sensitive information, that information is encrypted and transmitted to us in a secure way. You can verify this by looking for a closed lock icon at the bottom of your web browser, or looking for “https” at the beginning of the address of the web page. While we use encryption to protect sensitive information transmitted online, we also protect your information offline. Only employees who need the information to perform a specific job (such as a loan processor) are granted access to personally identifiable information. The computers/servers in which we store personally identifiable information are kept in a secure environment. 

 

Information from person(s) under the age of 18 

We do not knowingly solicit or collect information from any individuals under the age of 18. If we learn that we have collected personal information from a child under age 18, we will delete that information as quickly as possible.

Links to other sites

The website may contain links to other sites. Everfund does not control the information collection of sites that can be reached through links from our site. We encourage our users to be aware when they are leaving our site and to read the privacy statements of any site that collects personally identifiable information.

California Privacy Notice

This Notice applies to website visitors and customers in California. This Notice gives California residents additional information about our information collection and use practices required by the California Consumer Privacy Act of 2018 (“CCPA”), and also provides California residents with specific privacy rights.​

1.  California Information & Deletion Rights

If you are a California resident, the CCPA allows you to make certain requests about your personal information. Specifically, the CCPA allows you to request us to:

-   Inform you about the categories of personal information we collect or disclose about you; the categories of sources of such information, the business or commercial purpose for collecting your personal information, and the categories of third parties with whom we share/disclose personal information;

-   Provide access to and/or a copy of certain personal information we hold about you;

-   Delete certain personal information we have about you; and

-   Provide you with information about the financial incentives that we offer to you, if any.

 

Please note that certain information may be exempt from such requests under California law.  For example, we need certain information in order to provide the Services to you.

 

Verification: We will take reasonable steps to verify your identity before responding to a request, which may include, at a minimum, depending on the sensitivity of the information you are requesting and the type of request you are making, verifying your name, e-mail address, phone number and/or physical address.

 

You are also permitted to designate an authorized agent to submit certain requests on your behalf.  In order for an authorized agent to be verified, you must provide the authorized agent with signed, written permission to make such requests or a power of attorney.  We may also follow up with you to verify your identity before processing the authorized agent’s request.

2.  Notice of Right to Opt-Out of Sale of Personal Information

California residents may opt out of the “sale” of their personal information.  Under the CCPA, “sale” is broadly defined to mean the sharing of personal information with third parties who are not acting as our service providers or who are otherwise not restricted from using data only on our behalf or pursuant to an applicable CCPA exception.

In some circumstances, we may share certain of your information with financial institutions who may be able to provide you SBA or non-SBA loans. We will only share this information with your prior consent.

If you would like to opt out of our use of your information for such purposes that are considered a “sale” under California law, you may do so as outlined below.  The CCPA further provides you with the right to not be discriminated against (as provided for in applicable law) for exercising your access, deletion or sale opt out rights.

This type of information sharing with our advertising partners may be considered a “sale” under the CCPA. Digital Advertising Alliance (“DAA”) and Network Advertising Initiative (“NAI”) Opt-Outs

The Digital Advertising Alliance (“DAA”) and the Network Advertising Initiative (“NAI”) offer tools to provide consumers with choices as to whether participating third parties can use your information to provide targeted advertising. Google Opt-Out

If you are on the web, you can opt out of interest-based Google ads using Google’s Ads Settings. Google also participates in the DAA WebChoices Tool (above).

 

Facebook Ad Preferences

Facebook offers settings that may control what information Facebook uses about you or your device activity for advertising purposes. Login to Facebook and go to Settings > Ads > Ad Settings (web) or Ad Preferences > Ad Settings (app) for more information.

 

 Please Note

• The opt-outs described above are device- and browser-based. Because the information being shared relates to your device ID and/or browser ID, you must opt out on each device and each browser where you want your choice to apply.

• Opt-outs may be stored via cookies. If you clear cookies, your opt-out will no longer be valid and you must opt out again where you want your choices to apply.

• Everfund Commercial does not maintain or control the opt-out mechanisms and settings above and is not responsible for their operation.

• Exercising these choices does not prevent us from delivering contextual advertising, conducting cross-device tracking for us to serve you first-party ads directly, or using information for non-targeted advertising purposes, such as attribution and analytics. 

• The above choices will not opt you out of the use of previously collected and shared information or all interest-based advertising (such as that conducted on other sites).

3.  California “Shine the Light” Disclosure

 

If a company shares “personal information” (as defined in California’s “Shine the Light” law, Civil Code § 1798.83) with third parties for their direct marketing purposes (e.g., to send offers and information that may be of interest to you), California law requires either providing a mechanism by which consumers can obtain more information about such sharing over the prior calendar year, or providing a mechanism by which consumers can opt out of such sharing.  As discussed above, we provide an opt out for this sharing.  If you are a California resident and would like to opt out of sharing pursuant to this law, please use the email provided above.
